1 About these terms
1.1 Who we are
These terms apply to quotes, the supply of air conditioning units, installations, repairs and service plans provided by HVAC Cooling Solutions (Pty) Ltd ("HVAC-CS", "we", "us").
1.2 Accepting these terms
By accepting a quote from us or asking us to go ahead with work, you accept these terms. A written quote may add specific terms for your job. Where it does, the quote applies to that job.
1.3 Governing law
These terms are governed by the laws of South Africa, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA), where they apply. Nothing in these terms limits your rights under those Acts.
2 Quotes, prices and payment
2.1 Prices
All prices are in South African Rand and include VAT at the applicable rate.
Prices can change without notice, for example when supplier prices or exchange rates move. The price you pay is the price on the quote you accepted.
We take care to make sure prices and product descriptions are correct. If we find a pricing or description error before your unit is delivered or installed, we will contact you before going ahead, and you may cancel at no cost.
Capacity figures in BTU are the manufacturer's category references. Measured capacity may differ slightly, in line with the manufacturer's own disclaimer.
2.2 Payment
Unless your quote says otherwise, full payment is needed before a unit is delivered or an installation is scheduled.
3 Installation
3.1 Fixed installed price for 9 000 to 18 000 BTU wall units
Wall-mounted split units from 9 000 to 18 000 BTU can be sold with installation included in the price. These units plug into an existing wall socket and do not need distribution board work or an electrical isolator.

Anything quoted separately is confirmed with you before any work goes ahead.
3.2 What the fixed price assumes
The fixed price assumes the installation position is safe to reach, and that there is an existing wall socket in good working order, rated for the unit and compliant with SANS 10142-1.
The nearest suitable socket must be within 2.5 m of the indoor unit, matching the trunking allowance above. If it is further away, we quote the extra trunking and labour before going ahead.
If our technician finds that the existing electrical circuit is inadequate, non-compliant or unsafe, the installation stops at that point and we quote for the electrical work needed before continuing. We will not carry out unsafe electrical work under the fixed price, and stopping in this case does not break the fixed-price offer.
The fixed price does not include electrical work behind the socket, such as distribution board capacity or new circuits.
3.3 Units of 24 000 BTU and larger
For wall units of 24 000 BTU and larger, the outdoor unit needs its own circuit from the distribution board and an electrical isolator, as SANS 10142-1 requires. Because this depends on the site, installation for these units is quoted after a free site survey.
3.4 Site access and your responsibilities
You confirm that you have the authority to allow the installation at the address, including body corporate or landlord consent where needed.
The installation area must be clear and accessible on the scheduled date. Delays caused by restricted access may carry a rescheduling fee.
3.5 Workmanship warranty
We guarantee our installation workmanship for 12 months from the installation date. This covers defects caused by the installation itself and is in addition to the manufacturer's product warranty in section 4.
4 Product warranty
These manufacturer warranty periods apply to Midea units supplied and installed by us, in line with Midea and Livance's published terms:

Other brands carry their manufacturer's warranty, which we confirm on your quote.
4.1 Conditions of the extended manufacturer warranty
The warranty periods above apply only when:
- the unit was installed by HVAC Cooling Solutions (Pty) Ltd, or by an installer we appointed; and
- the unit is serviced at least twice a year by HVAC Cooling Solutions (Pty) Ltd, or by a service provider we appointed.
Our Essential service plan (section 5) is designed to meet the second condition. These conditions apply to the extended manufacturer warranty only and do not limit your rights in section 4.3.
4.2 What the extended warranty does not cover
- Return freight for parts, which is for your account.
- Labour for warranty repairs, which is for your account.
These exclusions apply to the extended manufacturer warranty only. They do not apply in the first six months after delivery (see section 4.3).
4.3 Your rights in the first six months
Section 56 of the Consumer Protection Act gives you an implied warranty that goods are reasonably suitable, of good quality and free of defects for six months from delivery. In this period we will repair, replace or refund a valid defect claim at our own cost, including labour. This applies no matter who installed or serviced the unit, and sections 4.1 and 4.2 cannot limit it.
4.4 Making a claim
Contact us with your invoice number, the unit's serial number and a description of the fault. We will arrange an assessment and, where the claim is valid, deal with it under sections 4.1 to 4.3.
5 Service plans
Included in each service
- Indoor filter clean and check

- Written service report, kept for your warranty records
Not included
- Breakdown callouts between scheduled services, charged at our standard callout rate
- Refrigerant top-ups, leak repairs and any work on the sealed refrigerant circuit, which an SAQCC Gas registered technician carries out and we quote separately
- Replacement parts
- Travel beyond 15 km from our nearest service base, charged by travel zone as shown on your quote
5.1 Where plans are available
Service plans are available in Gauteng, Durban, Cape Town and selected areas of the Free State. We confirm that we can service your address before a plan starts.
5.2 Term, billing and your right to cancel
Under section 14 of the Consumer Protection Act, a fixed-term consumer agreement may not be longer than 24 months, and you may cancel at any time with 20 business days' written notice, whatever minimum term was mentioned at sign-up. These terms cannot take that right away or reduce it.
Plans renew automatically at the end of each term unless you cancel as above.
The plan price is 10% less than our standard per-service rate, in return for your commitment to the plan. It is not an early-cancellation penalty.
5.3 Which unit a plan covers
Each plan is registered to one installed unit. When you sign up, or before the first visit, we need the unit's make, model, serial number, installation date and site address.
6 Supply and scheduling
We supply and install in Gauteng, Durban, Cape Town and selected areas of the Free State. Tell us your address and we will confirm that we cover it.
Units are currently available within an estimated 5 to 7 days.
For 9 000 to 18 000 BTU units, delivery and installation happen on the same visit. For units of 24 000 BTU and larger, delivery may be scheduled separately, with installation following the site survey in section 3.3.
7 Cancellations and refunds
7.1 Before delivery
You can cancel at any time before your unit is delivered, for a full refund at no cost to you. This is our own policy and is in addition to your rights by law.
7.2 Cooling-off period for agreements made electronically
If you accepted our quote electronically, section 44 of the Electronic Communications and Transactions Act lets you cancel within 7 days of receiving the goods, without a reason or penalty, as long as the goods are unused and in their original packaging.
- Returning the goods is at your own cost.
- We refund you within 30 days of the date you tell us you are cancelling.
- This right ends once we have installed the unit at your request, because the service has then been performed.
7.3 Faulty or incorrect goods
If goods are faulty, unsafe or not as described, the Consumer Protection Act entitles you to a repair, replacement or refund at no charge within six months of delivery (see section 4.3).
7.4 How to cancel or return
Contact us with your invoice number and the reason before sending anything back. We will confirm the process and, where it applies, arrange collection.
8 Privacy
We process personal information in line with the Protection of Personal Information Act 4 of 2013 (POPIA).
8.1 What we collect
- Your contact and site details: name, address, phone number and email
- Your quote, invoice and payment history
- For installations and service plans: each unit's make, model, serial number and site address
8.2 Why we collect it
- To quote, supply, install and service your equipment
- To run service plans, including scheduling and warranty records
- To meet our legal duties, including tax and consumer protection record-keeping
8.3 Who we share it with
We share your information only as far as needed to carry out your job: with our installation and service technicians, and with suppliers and manufacturers for warranty claims. We do not sell your personal information.
8.4 Your rights
You can ask to see, correct or delete your personal information, subject to records we must keep by law, such as tax records. To do this, or to make a complaint, contact our Information Officer below.
